What Are the Fence Height Regulations for My Deck in England?

I'm building a deck that's 2.5 meters away from the boundary fence in my garden, and the deck will be about 24 cm high. I want to enclose this area with a fence because it's unusable due to rubble and tree stumps, plus I want to regain some privacy after having to cut down some trees. I'm planning to let this area go wild naturally, but I want to know how tall I can build the fence to separate the deck from this natural space. My garden is south-facing, with garages and a shed around 2.5m high on either side. I want the fence to stretch from the garage wall to the shed, with a removable panel for access. Any advice?

Since your deck won't have a pitched roof, the height limit is indeed 2.5 meters from the ground. If you're planning a fence above that, it might count as a garden structure, so you'll want to be cautious to avoid issues down the line. Sounds like 2.5m should work for your needs without a roof.

Thanks for the clarification! I won't be adding a roof, so aiming for the 2.5m height should be perfect.

It sounds like you're in a bit of a gray area. Legally, the best advice would be to check in a forum like r/legaladviceuk. But realistically, as long as no one complains, you'll probably be fine. It's good that you've already talked to your neighbor; that goes a long way! Just be mindful of shadowing; it can affect both your garden and theirs at different times of the day. Also, consider how you'll manage that 'wild' area. If weeds take over, what will you do? Remember, maintaining clarity on property boundaries is crucial—if the neighbors change, an invisible fence could lead to issues later on. What are your thoughts?

I've already discussed it with the neighbor. The trees provided our privacy, so they understood why I had to remove them. As for the shadow, any effect on their garden will be minimal since the fence will mostly cast shade in my area.
