LVP Flooring Issues: Can I Hold Installers Liable for No Moisture Barrier?

I recently noticed that all the LVP (Luxury Vinyl Plank) flooring that was installed in my Florida home back in March 2018 is cupping. Initially, I didn't think much of it, but now that I'm planning to sell my house, my realtor advised me to address the issue before listing. I've come to find out that the installers didn't use a moisture barrier, and the planks were also installed too tightly to the edges, which contributed to the problem. The installers initially said it would be fixable, but now they claim it can't be saved and I need to replace the whole floor. What I'm wondering is, am I stuck paying for their mistake, or can I hold them accountable for not using a moisture barrier? Any advice would be appreciated!

It's going to be tricky since it's been six years since the install. You might find it hard to argue liability because the issue developed over time. A lot of contractors will push back on long-term problems like this, especially if it wasn't reported earlier. You probably should have noticed it sooner, but that doesn’t mean they’re entirely off the hook either. It's worth a chat with a flooring expert for a second opinion. Good luck!

I’d suggest getting at least three quotes from different contractors for the repair work. Don't go back to the original installer, since they might just try to sell you more services. Getting multiple opinions will also give you some leverage when discussing the issue with the first company. Just be sure to document everything!
